1. Introduction & Acceptance

These Terms & Conditions ("Terms") govern the use of all services offered under the FixorAssist brand by Fixorauto Private Limited ("Company", "FixorAssist", "we", "us", "our"), a company incorporated under the laws of India (CIN: U45200DL2025PTC457074), having its registered office at B24, Okhla Main Market, Delhi – 110025.

By registering on our platform, booking a service, purchasing a warranty, requesting Roadside Assistance, ordering spare parts, or otherwise availing any FixorAssist service ("Customer", "User", "you"), you agree to be bound by these Terms. If you do not agree, please discontinue use of our services.

These Terms apply across all FixorAssist verticals; each vertical has additional service-specific terms set out in Sections 2 to 5 below, which must be read together with this Section 1 and the General Terms in Section 6.

2. Vertical 1 – Roadside Assistance (RSA) – Bike & Car

FixorAssist offers Pan-India Roadside Assistance for two-wheelers and four-wheelers through a network of 15,000+ empanelled service providers, garages, towing/crane partners, and field technicians.

2.1 Scope of Service

  • Roadside Assistance covers services including but not limited to: towing, flat-tyre replacement, battery jump-start, fuel delivery, minor on-spot repair, lockout assistance, and accident/breakdown support, as per the specific plan purchased by the Customer.
  • The exact list of inclusions, exclusions, and coverage limits (e.g., number of calls per year, towing distance in km) shall be as specified in the Customer's chosen RSA plan/policy schedule.
  • Services are rendered through our network of 15,000+ empanelled service providers across India; actual service provider assigned will depend on real-time availability at the Customer's location.
  • The specific RSA plan purchased by the Customer from FixorAssist — including its validity, number of covered calls, towing distance limit, and inclusions/exclusions — shall be as confirmed in the order/policy confirmation shared with the Customer at the time of purchase, and shall be binding on both parties for that plan period.

2.2 Eligibility & Booking

  • RSA services are available only for vehicles registered in India and in a condition eligible for roadside support (i.e., not involved in a legal dispute, seizure, or major accident requiring police/insurance investigation, unless specifically covered).
  • Requests must be raised through the FixorAssist app, website, call centre, or WhatsApp helpline, with accurate vehicle number, location, and nature of breakdown.
  • Providing false, incomplete, or misleading information at the time of request may result in denial or cancellation of service without refund.

2.3 Response & Turnaround Time (TAT)

  • FixorAssist shall use commercially reasonable efforts to dispatch the nearest available service provider within the response time committed for the Customer's plan and location; actual arrival time may vary due to traffic, weather, remote location, or force majeure events.
  • TAT commitments are indicative service standards and not a guarantee; delays beyond our reasonable control shall not constitute breach of these Terms.

2.4 Charges, Payment & Cancellation

  • Charges for RSA services (plan fee, per-call charge, spare parts, or towing beyond covered distance) shall be as communicated at the time of purchase or at the time of service, and are payable through the modes supported on the platform.
  • Once a service provider has been dispatched, cancellation by the Customer may attract a nominal dispatch/cancellation charge as applicable.
  • Refunds, where applicable, shall be processed as per FixorAssist's refund policy within a reasonable time after verification.

2.5 Liability

  • FixorAssist acts as a facilitator connecting Customers with empanelled service providers; the actual repair/towing service is rendered by the independent service provider, who remains responsible for the quality and workmanship of the service performed.
  • FixorAssist's liability, if any, shall be limited to the value of the specific service/plan availed and shall not extend to indirect, incidental, or consequential loss.

2.6 Car RSA – Additional Terms

The following additional terms apply specifically to Roadside Assistance for private cars and, where expressly covered under the plan, sport utility vehicles and electric cars.

2.6.1 Scope for Cars, SUVs & Electric Vehicles

  • Car RSA is available for vehicles covered under a valid FixorAssist membership/plan, subject to vehicle eligibility and the specific plan wording, and typically covers sudden breakdowns during a journey such as flat tyre, dead battery, key-related issues, fuel shortage, minor mechanical/electrical failure, and towing following an eligible roadside incident.
  • Depending on the plan selected, covered services may include minor on-spot repair, jump-start assistance, tyre change/puncture support, emergency fuel delivery, lockout assistance, towing to the nearest suitable or authorised workshop, and, where included, accident towing or limited electric-vehicle (EV) support.

2.6.2 Vehicle Eligibility & Special Conditions

  • Large SUVs, luxury vehicles, modified vehicles, imported vehicles, all-wheel-drive vehicles, and electric vehicles may require specialised handling/recovery methods and may be subject to additional conditions under the plan.
  • For electric vehicles, on-site roadside repair is often limited by design; in many cases the vehicle will need to be transported to a suitable service facility rather than repaired at the roadside.

2.6.3 Service Limits & Charges

  • Car RSA plans commonly place limits on the number of service calls permitted per year and on the maximum complimentary towing distance; usage beyond these limits shall be chargeable as per the plan/policy schedule.
  • Spare parts, fuel cost, tolls, parking, ferry charges, workshop labour, and any towing distance beyond what is covered under the plan shall be payable by the Customer.

2.6.4 Flatbed Towing for Luxury, AWD & Electric Vehicles

  • Luxury, low-ground-clearance, all-wheel-drive, hybrid, and most electric vehicles shall ordinarily be transported using a suitable flatbed/tilt-bed recovery vehicle with all wheels off the road surface, to avoid damage to the driveline, suspension, underbody, electric motor, inverter, regenerative braking system, or other sensitive components that can result from towing with wheels on the road.
  • Only manufacturer-approved recovery/tow points, soft straps, and wheel straps shall be used for loading and transport; high-voltage cables, battery housings, suspension arms, bumpers, and other non-approved structural points shall not be used as lifting, winching, or attachment points.

2.6.5 Car RSA Exclusions

  • Car RSA does not cover breakdowns or damage arising from illegal use, driving under the influence, racing, off-road use not permitted under the plan, or repeated/deliberate misuse of the service.
  • Routine servicing, scheduled maintenance, major repairs, accident repair costs, and reimbursement for repairs carried out without FixorAssist's authorisation are excluded.
  • Medical expenses, police/legal charges, insurance deductibles, loss of business or use, and personal belongings left inside the vehicle are also excluded from Car RSA coverage.

2.6.6 Location & Recovery Restrictions

  • Service may be refused, delayed, or charged extra where the vehicle is located in an inaccessible, unsafe, flooded, privately restricted, off-road, basement, or otherwise non-motorable area, or where the recovery provider cannot safely or legally reach the vehicle, including during natural calamities or civil disturbance.

2.6.7 Customer Disclosure

  • The Customer must disclose at the time of requesting service whether the vehicle is electric, hybrid, luxury, modified, all-wheel-drive, low-clearance, or already accident-damaged; any delay, refusal of service, or additional recovery cost arising from incomplete or inaccurate disclosure may be charged to the Customer.

2.6.8 Limitation of Liability (Car RSA)

  • FixorAssist's liability under Car RSA is limited to the roadside assistance and recovery support specifically described in the Customer's selected plan; liability for indirect loss, consequential damage, delay-related loss, loss of use, personal belongings, and the repair quality of the receiving workshop is excluded, save as otherwise expressly stated in these Terms.

3. Vertical 2 – Spare Parts Supply (Pan India)

3.1 Scope

  • FixorAssist facilitates the sourcing and supply of genuine, OEM, and OES-grade automotive spare parts to workshops, garages, fleet operators, and individual customers across India through its Pan-India vendor and supplier network.
  • Product listings, specifications, brand, and compatibility information are provided based on details shared by suppliers/OEMs and are subject to verification at the time of order confirmation.

3.2 Ordering, Pricing & Payment

  • Orders are confirmed only upon successful payment or approved credit terms (for empanelled B2B partners/workshops) and receipt of order confirmation from FixorAssist.
  • Prices displayed are exclusive of applicable taxes, freight, and handling charges unless expressly stated as inclusive.
  • FixorAssist reserves the right to revise prices, correct listing errors, or cancel an order in case of pricing/inventory errors, with a full refund of any amount paid for such cancelled order.

3.3 Delivery

  • Delivery timelines communicated at the time of order are estimates and may vary based on part availability, supplier location, and logistics partner performance.
  • Risk in the goods passes to the Customer upon delivery at the designated address; the Customer must inspect the consignment for damage/shortage at the time of delivery and report any discrepancy within 48 hours.

3.4 Returns, Replacement & Warranty

  • Parts found to be defective, damaged in transit, or not matching the confirmed order specification are eligible for return/replacement as per FixorAssist's return policy, subject to the part being unused, in original packaging, and reported within the specified window.
  • Electricals, custom-ordered parts, and parts installed/used by the Customer are generally non-returnable, except where covered under manufacturer warranty.
  • Any manufacturer warranty on a spare part shall be honoured as per the respective OEM/supplier's warranty terms; FixorAssist facilitates the warranty claim process but the warranty obligation rests with the OEM/supplier.

3.5 Vendor & Transportation Partner Terms (Supply & Logistics)

This Section 3.5 applies specifically to empanelled Original Equipment (OE)/OEM-authorised dealers, aftermarket suppliers, distributors, and transportation/logistics partners ("Vendor"/"Partner") who fulfil spare parts orders raised by FixorAssist for its Pan-India workshop, bodyshop, and RSA network — as distinct from the Customer-facing terms in Sections 3.1 to 3.4 above. Participation in the FixorAssist Spare Parts Marketplace, including any order raised through FixorAssist's ordering/API systems, constitutes a Vendor/Partner's acceptance of this Section 3.5. Where a separate signed empanelment agreement exists with a specific Vendor/Partner, that agreement shall prevail to the extent of any conflict.

3.5.1 Ordering & Purchase Orders

  • Orders shall be placed only through FixorAssist's ordering system/registered Purchase Order (PO) format bearing a unique PO number.
  • The Vendor must confirm PO acceptance, part availability, and expected dispatch date within 24 hours of PO receipt.
  • Only parts against claim-approved/work-order-approved requests shall be supplied, unless otherwise agreed in writing for stock/bulk orders.
  • Genuine OEM parts must carry manufacturer part numbers, batch/lot traceability, and original packaging with tamper-evident seals where applicable.

3.5.2 Invoicing & Payment Terms

  • Invoices must be raised only against a valid PO and must reference the PO number, claim/work-order number, part numbers, HSN codes, and GST details.
  • Payment cycle and credit period shall be as per the empanelment agreement; in the absence of a specific agreement, the standard credit period is 30 days from receipt of a compliant invoice and delivery confirmation.
  • Any short-supply, wrong-part, or damaged-part claim shall be settled by way of debit note/credit note prior to release of payment for the disputed line item.

3.5.3 Quality, Warranty & Returns (Vendor Obligations)

  • All parts supplied must be genuine, unused, and free from manufacturing defects, carrying the standard OEM/brand warranty applicable to the part.
  • The Vendor shall accept the return of parts found defective, mismatched, or damaged in transit (subject to Clause 3.5.6) within 7 days of delivery, with full credit note issuance.
  • Supply of counterfeit, refurbished, or non-genuine parts against a genuine-parts order shall constitute a material breach and may result in immediate de-empanelment.

3.5.4 Delivery Timelines (Pan-India TAT)

  • The Vendor/Transportation Partner shall provide a tracking reference (AWB/consignment number) at the time of dispatch for every shipment.
  • Delays beyond the committed TAT must be proactively communicated to FixorAssist's designated coordinator along with a revised ETA.

3.5.5 Packaging & Handling

  • Parts must be packed to withstand standard road/air freight handling, using OEM packaging or equivalent protective packaging for fragile/precision components.
  • Each shipment must carry a packing slip listing part numbers, quantities, PO reference, and delivery point address.

3.5.6 Freight & Logistics Charges

  • Logistics/freight charges shall be applied as a percentage enhancement on the invoice value, as finalised and communicated by FixorAssist for each Vendor/region.
  • Where logistics costs are bundled into the agreed part pricing for a Vendor, no separate freight line shall be charged unless the order falls outside the standard delivery zone or involves expedited/urgent dispatch.
  • Urgent/emergency dispatch outside the standard TAT may attract additional expedited-freight charges, to be pre-approved by FixorAssist before dispatch.

3.5.7 Risk, Insurance & Transit Damage

  • Risk in the goods passes to FixorAssist only upon confirmed delivery and acknowledgement (physical or digital proof of delivery) at the Delivery Point.
  • The Vendor/Transportation Partner shall be responsible for adequate transit insurance; any loss, breakage, or damage in transit shall be replaced or credited at no additional cost to FixorAssist.
  • Shortages or damage must be reported within 48 hours of delivery, supported by photographic evidence, for a claim to be processed.

3.5.8 Pan-India Coverage Obligation

  • Empanelled Vendors/Transportation Partners agree to service all Pan-India delivery points nominated by FixorAssist within their declared serviceable geography, without discrimination in pricing or priority based on location.
  • Where a Vendor cannot service a particular geography, FixorAssist reserves the right to route that order through an alternate empanelled Vendor for the same brand/part.

3.5.9 Confidentiality, Term & Termination (Vendor/Partner)

  • Pricing, PO volumes, and workshop/customer data shared under this arrangement are confidential and shall not be disclosed to third parties.
  • Empanelment may be terminated by either party with 30 days' written notice, or with immediate effect for breach of quality, genuineness, or repeated TAT/SLA failures.
  • FixorAssist reserves the right to revise pricing structures, TAT norms, and logistics charges for Vendors/Partners, with prior written communication.

4. Vertical 3 – Service & Maintenance (Online Platform)

4.1 Scope

  • FixorAssist enables Customers to book periodic service, general repair, denting-painting, and maintenance services for their vehicles through its online platform (app/website), which connects Customers to empanelled workshops and service centres.
  • Service packages (basic, standard, comprehensive, etc.) and their inclusions are as described on the platform at the time of booking.

4.2 Booking, Estimates & Approval

  • A Customer's booking is confirmed only after selection of service package, vehicle details, preferred date/time slot, and successful payment/advance (where applicable).
  • Any additional repair work identified during service (beyond the originally booked package) shall be carried out only after sharing a revised estimate with, and obtaining approval from, the Customer.
  • Final billing shall reflect the approved package plus any additionally approved work, applicable taxes, and consumables.

4.3 Service Standards & Timelines

  • Estimated service completion time shall be communicated by the servicing workshop; FixorAssist shall make reasonable efforts to ensure adherence, though actual completion may vary based on the nature of repair, parts availability, and workshop load.
  • The Customer shall inspect the vehicle at the time of delivery/handover and raise any concerns regarding workmanship within the timeframe specified in the service invoice/job card.

4.4 Service Warranty & Liability

  • Workmanship warranty, if offered, shall be as specified on the invoice/job card issued by the servicing workshop and is subject to the vehicle not being serviced/repaired elsewhere for the same issue in the interim.
  • FixorAssist facilitates the booking and quality-monitoring of the service through its empanelled workshop network; the workshop remains primarily responsible for the actual repair/service performed, and FixorAssist's role is limited to platform facilitation, quality oversight, and grievance redressal support.

4.5 Pickup & Drop Facility

  • Where opted by the Customer, FixorAssist shall arrange for pickup of the vehicle from the Customer's specified location and drop-back after completion of service, subject to serviceability of the pin code/area and availability of the pickup & drop facility at the time of booking.
  • Pickup and drop charges, if applicable, shall be as displayed on the platform at the time of booking and are separate from the service/repair charges, unless offered free as part of a specific package or promotion.
  • At the time of pickup, a joint vehicle inspection (including odometer reading, fuel level, existing dents/scratches, and belongings left in the vehicle) shall be recorded and shared with the Customer; the Customer must remove all personal belongings and valuables from the vehicle prior to handover, and FixorAssist/the workshop shall not be liable for any item left inside the vehicle.
  • The Customer or an authorised representative must be present and available at the scheduled pickup and drop time slot; failure to be available may result in rescheduling of the pickup/drop, and any resulting delay in service shall not be attributable to FixorAssist.
  • The vehicle shall be handed over only after verification of the Customer's identity/booking details and, at drop, only to the Customer or the authorised representative named at the time of booking.
  • During transit under the pickup & drop facility, the vehicle shall be covered under the transit liability/insurance arrangement (if any) disclosed at the time of booking; any damage occurring during such transit, if attributable to the pickup & drop service, shall be assessed and addressed as per FixorAssist's claims process for pickup & drop related damage.
  • Cancellation or rescheduling of a pickup & drop request must be made within the window specified on the platform; last-minute cancellations (after the service vehicle has been dispatched for pickup) may attract a nominal cancellation charge.

5. Vertical 4 – Extended Warranty Sales (Via Third Party)

5.1 Scope

  • FixorAssist markets and distributes Extended Warranty / Vehicle Service Contract products underwritten and administered by third-party warranty providers/insurers ("Warranty Provider") empanelled with FixorAssist.
  • FixorAssist acts solely as a distribution/referral partner for such Extended Warranty products; the contract of warranty is between the Customer and the respective Warranty Provider, governed by that Warranty Provider's own terms, conditions, coverage, exclusions, and claim process.

5.2 Purchase & Disclosure

  • At the time of purchase, the Customer shall be shown/shared the applicable Warranty Provider's policy wording, coverage inclusions/exclusions, claim procedure, and premium/price, and purchase shall be deemed as acceptance of those third-party terms.
  • The Customer is responsible for reviewing the third-party warranty document carefully; FixorAssist shall assist with clarifications but is not the issuer of the warranty contract.

5.3 Claims

  • Extended Warranty claims shall be processed as per the Warranty Provider's claim process and turnaround time; FixorAssist may provide claim-facilitation and coordination support between the Customer and the Warranty Provider but does not guarantee approval or timeline of the claim, which rests solely with the Warranty Provider.
  • FixorAssist shall not be liable for rejection, delay, or shortfall in claim settlement by the Warranty Provider; such matters shall be resolved directly between the Customer and the Warranty Provider as per their contract.

5.4 Cancellation & Refund

  • Cancellation and refund of an Extended Warranty (including free-look period, if any) shall be governed by the respective Warranty Provider's policy; FixorAssist shall facilitate the cancellation request but the refund amount and timeline shall be as determined by the Warranty Provider.

5.5 Extended Warranty Program – Detailed Terms

Where an Extended Warranty is issued as a "Program" under a Certificate of Enrolment — whether administered directly by FixorAssist or in part through a third-party insurer, administrator, or workshop partner — the detailed terms in this Section 5.5 shall apply in addition to Sections 5.1 to 5.4 above, to the extent not inconsistent with the specific Warranty Provider's own policy wording.

Note: figures shown in brackets [__] below (durations, fee percentages, caps) are placeholders to be finalised as per FixorAssist's actual Extended Warranty pricing and operations before being issued to customers.

5.5.1 Definitions

  • "Extended Warranty" or "EW" means the coverage described in the Certificate of Enrolment, commencing on expiry of the Vehicle's original Manufacturer's Warranty or the applicable waiting period, whichever is later.
  • "Certificate of Enrolment" means the document issued by FixorAssist (or its Warranty Provider) confirming the Vehicle, Owner, Plan Tier, coverage period, and consideration paid.
  • "Authorised Workshop" means a workshop empanelled within the FixorAssist Cashless Facility network or otherwise designated in writing by FixorAssist.
  • "Consideration" means the one-time or instalment payment made by the Owner in exchange for enrolment in the Program.
  • "Claim" means a request made by the Owner for repair or replacement of a covered part following a mechanical or electrical breakdown during the EW period.
  • "Wear and Tear" means the gradual deterioration of a part through normal operating use, not resulting from a sudden mechanical or electrical failure.

5.5.2 Eligibility & Enrolment

  • The Program is available to four-wheeler and two-wheeler passenger vehicles that are within the Manufacturer's original warranty period, or within [__] days of its expiry, at the time of enrolment.
  • Enrolment requires: (i) a valid Pre-Delivery/Condition Inspection report where the Vehicle is not new, (ii) submission of the Extended Warranty Registration Form, and (iii) payment of the applicable Consideration in full or as per the agreed instalment schedule.
  • FixorAssist reserves sole discretion to accept, decline, or impose additional inspection conditions on any enrolment application, particularly for used or high-mileage vehicles.
  • Extended Warranty is not available for vehicles used for commercial passenger transport (unless a Commercial Plan is separately purchased), modified vehicles, salvage-titled vehicles, or vehicles with tampered odometers.

5.5.3 Coverage

  • Subject to these Terms, FixorAssist undertakes to arrange repair or replacement of components listed as covered under the Owner's selected Plan Tier, where failure results from a defect in material or workmanship under normal use and maintenance.
  • The specific parts list, coverage period, kilometre cap, and claim cap applicable to the Owner's Vehicle and selected Plan Tier are as stated in the Certificate of Enrolment.
  • Coverage is limited to the lower of the coverage period or kilometre cap stated in the Certificate of Enrolment, whichever occurs first.
  • All repairs under the Program must be carried out exclusively at an Authorised Workshop; repairs undertaken elsewhere without FixorAssist's prior written approval shall not be reimbursed and may void the remaining Program.

5.5.4 Exclusions

The Program does not cover loss, damage, or failure arising from or attributable to:

  • Normal wear and tear, consumables, and routine maintenance items (e.g., filters, fluids, brake pads, wiper blades, bulbs, batteries beyond the applicable sub-limit).
  • Accidents, collisions, misuse, negligence, racing, or off-road use.
  • Fitment of non-genuine, non-approved, or performance/racing parts, or unauthorised modification of the Vehicle.
  • Failure to follow the Manufacturer's or FixorAssist's prescribed service schedule, or lapses in scheduled maintenance.
  • Environmental or force majeure events, including flood, fire, lightning, earthquake, riot, or act of God.
  • Cosmetic damage, corrosion, rust, paint, upholstery, glass, and infotainment/software issues, unless a specific add-on cover is purchased.
  • Odometer tampering or falsification of service/claim records, which shall render the Program void with immediate effect and without refund.
  • Consequential losses, including loss of use, towing beyond the covered limit, hotel expenses, or loss of income, unless separately covered under a linked Roadside Assistance plan.

5.5.5 Consideration & Payment Terms

  • The Consideration payable for enrolment shall be as quoted at the time of sale and recorded in the Certificate of Enrolment, exclusive of applicable GST, which shall be charged additionally at the prevailing rate.
  • Consideration may be paid as a single upfront payment or, where offered, in instalments through FixorAssist's approved payment partner; the Program shall stand suspended if any instalment remains unpaid beyond [__] days of its due date.
  • The Consideration is non-refundable once a Claim has been admitted and paid under the Program, save as expressly provided in Clause 5.5.7.
  • FixorAssist may revise Consideration for renewal or fresh enrolment from time to time; revised pricing shall not affect an already-active Certificate of Enrolment.

5.5.6 Claim Procedure

  • The Owner must report a suspected covered failure to FixorAssist's claims helpline or the Authorised Workshop promptly, and in any event within [__] hours of the failure being noticed, and prior to commencing any repair.
  • The Owner shall make the Vehicle available for inspection at the Authorised Workshop along with the Certificate of Enrolment, service history, and Vehicle registration documents.
  • FixorAssist or its designated surveyor/workshop shall assess the Claim and communicate acceptance, partial acceptance, or rejection, ordinarily within [__] business days of inspection.
  • Where a Claim is accepted, the covered repair cost shall be settled on a cashless basis at an Authorised Workshop, subject to the applicable claim cap, deductible (if any), and sub-limits stated in the Certificate of Enrolment.
  • FixorAssist reserves the right to require a second opinion, request additional documentation, or depute an inspector for high-value Claims before authorising repair.

5.5.7 Cancellation & Refund (Program)

  • The Owner may cancel the Program in writing within [__] days of enrolment ("free-look period"), provided no Claim has been made, for a full refund less applicable administrative charges.
  • Cancellation after the free-look period, where no Claim has been made, may be permitted at FixorAssist's discretion on a pro-rata basis for the unexpired coverage period, less administrative charges as prescribed by FixorAssist.
  • No refund shall be payable once a Claim has been admitted and paid, or where the Program is terminated under Clause 5.5.4 for tampering, fraud, or misrepresentation.
  • The Program has no surrender value beyond the refund mechanism described in this Clause 5.5.7.

5.5.8 Transferability

  • The Extended Warranty is transferable to a subsequent owner of the same Vehicle for the remaining coverage period, subject to intimation to FixorAssist within [__] days of change of ownership and payment of the prescribed transfer fee, if any.
  • The Extended Warranty is not transferable to another vehicle under any circumstances.

5.5.9 Limitation of Liability (Program)

  • FixorAssist's liability under the Program is limited strictly to the repair or replacement of covered parts, subject to the claim caps and sub-limits stated in the Certificate of Enrolment, and shall not exceed the aggregate Consideration paid by the Owner in any Program year.
  • FixorAssist shall not be liable for any indirect, incidental, or consequential loss, including loss of use of the Vehicle, business interruption, or loss of income, arising from a covered failure or from delay in repair.
  • Where the Program is administered in part through a third-party insurer, administrator, or workshop partner, FixorAssist's role is limited to facilitation, and the terms of the underlying insurance or service contract (where applicable) shall also apply.

5.5.10 Owner's Obligations

  • Maintain and service the Vehicle strictly as per the Manufacturer's recommended schedule at an Authorised Workshop, and retain all service records for production at the time of Claim.
  • Not permit the Vehicle to be driven or operated in a manner inconsistent with the Manufacturer's specifications.
  • Promptly report any suspected covered failure and avoid continued use of the Vehicle where doing so may aggravate the damage.
  • Provide accurate information at the time of enrolment and Claim; any misrepresentation shall entitle FixorAssist to reject the Claim and/or terminate the Program without refund.

5.5.11 Amendments (Program)

FixorAssist reserves the right to amend these Program terms, the covered parts list, claim procedure, or Authorised Workshop network from time to time. Material changes affecting an active Certificate of Enrolment shall be communicated to the Owner and shall not reduce coverage already accrued for that Certificate.

5.5.12 Governing Law & Dispute Resolution (Program)

  • These Program terms shall be governed by and construed in accordance with the laws of India.
  • Any dispute arising out of or in connection with these Program terms shall first be referred to FixorAssist's grievance redressal desk. If unresolved within [__] days, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (as amended), by a sole arbitrator appointed by FixorAssist, with the seat and venue of arbitration at New Delhi, conducted in English.
  • Subject to the arbitration clause above, the courts at Delhi alone shall have exclusive jurisdiction over all matters arising under these Program terms.

5.5.13 Miscellaneous

  • These Program terms, together with the Certificate of Enrolment, constitute the entire agreement between the Owner and FixorAssist regarding the Program and supersede all prior representations, whether oral or written.
  • If any provision of these Program terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • Failure by FixorAssist to enforce any provision shall not be construed as a waiver of that provision.

6. General Terms (Applicable Across All Verticals)

  • Eligibility: Services are available to individuals who are at least 18 years of age and competent to contract under the Indian Contract Act, 1872, and to duly authorised representatives of business/fleet customers.
  • Pricing & Taxes: All prices are subject to applicable GST and other statutory levies as per prevailing law, unless stated otherwise.
  • Force Majeure: FixorAssist shall not be liable for any delay or failure in performance arising from causes beyond its reasonable control, including natural disasters, strikes, riots, government action, network/technical failure, or other force majeure events.
  • Third-Party Service Providers: All services under RSA, Spare Parts, Service & Maintenance, and Extended Warranty verticals are ultimately rendered/underwritten by independent, empanelled third parties (garages, vendors, workshops, or Warranty Providers). FixorAssist's role is that of a technology and service-facilitation platform, and it exercises reasonable diligence in empanelment and quality monitoring, but does not guarantee the acts or omissions of such independent third parties beyond what is expressly stated in these Terms.
  • Data & Privacy: Customer data (personal, vehicle, and location data) collected for service delivery shall be used and protected in accordance with FixorAssist's Privacy Policy, available on www.fixorassist.com.
  • Grievance Redressal: Any complaint or grievance may be raised through the FixorAssist app/website/helpline; FixorAssist shall endeavour to resolve the same within a reasonable time in accordance with its grievance redressal mechanism.
  • Amendments: FixorAssist reserves the right to amend, update, or modify these Terms and vertical-specific terms at any time, with the revised version effective upon publication on www.fixorassist.com; continued use of services constitutes acceptance of the updated Terms.
  • Governing Law & Jurisdiction: These Terms shall be governed by the laws of India, and the courts at New Delhi shall have exclusive jurisdiction over any disputes arising hereunder.
  • Entire Agreement: These Terms, together with the specific plan/policy/order details shared at the time of purchase, constitute the entire agreement between the Customer and FixorAssist with respect to the subject matter herein.
