1. Introduction

This Privacy Policy (“Policy”) describes how Fixorauto Private Limited (CIN: U45200DL2025PTC457074), operating under the brand name “FixorAssist”, with its registered office at B24, Okhla Main Market, Delhi – 110025 (“FixorAssist”, “we”, “us”, or “our”), collects, uses, stores, discloses, and protects personal information of users (“you”, “your”, or “Customer”) who access our website (www.fixorassist.com), mobile applications, WhatsApp/chatbot channels, call centre, or any of our Pan-India multi-vertical automotive services (collectively, the “Services”).

This Policy specifically covers the following FixorAssist service verticals: (a) Roadside Assistance (RSA), (b) Service & Maintenance, (c) Extended Warranty Sale, and (d) Car & Bike Spare Parts Supply. It should be read together with our Terms of Use. By accessing or using any FixorAssist Service, you consent to the collection and processing of your personal data as described in this Policy.

This Policy is published in accordance with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and rules made thereunder, as applicable in India.

2. Scope of this Policy

This Policy applies to personal data collected through:

  • The FixorAssist website, mobile app, and customer portals
  • WhatsApp chatbot and automated messaging channels
  • RSA call centre, breakdown response, and towing coordination
  • Service & maintenance bookings at partner/network workshops
  • Extended warranty policy sale, activation, and claims
  • Spare parts ordering, quotation, and marketplace transactions
  • Franchise, dealer, insurer, OEM, and workshop partner interactions where end-customer data is shared with FixorAssist

3. Information We Collect

3.1 Information You Provide to Us

  • Identity details: name, mobile number, email address, date of birth
  • Address details: billing address, pickup/breakdown location, delivery address
  • Vehicle details: registration number, make, model, variant, year, VIN/chassis number, odometer reading, fuel type
  • Policy/warranty details: policy number, plan tier, coverage dates, insurer name (where applicable)
  • Payment information: billing details, transaction references (card/bank details are processed by our PCI-DSS compliant payment gateway partners and are not stored on FixorAssist servers)
  • Communications: call recordings, chat/WhatsApp transcripts, emails, and feedback/ratings
  • Documents you upload: driving licence, RC copy, insurance copy, PDI/inspection photos, claim documents, invoices

3.2 Information Collected Automatically

  • Device information: device type, operating system, browser, IP address, unique device identifiers
  • Location data: real-time GPS location during an active RSA breakdown request, service pickup, or delivery (collected only with permission and for the duration necessary to fulfil the request)
  • Usage data: pages viewed, features used, session duration, app crash logs
  • Cookies and similar tracking technologies on our website (see Section 9)

3.3 Information from Third Parties

  • Insurance partners, OEMs, dealers, and fleet operators who refer or onboard you for RSA, warranty, or service programs
  • Empanelled workshops and bodyshops that share job-card, estimate, and repair-status data with us
  • Payment gateways, logistics/towing partners, and spare parts vendors involved in fulfilling your request

4. How We Use Your Information

  • To register you and create/manage your customer or vehicle profile
  • To dispatch roadside assistance (towing, jump-start, flat-tyre, fuel delivery, on-spot repair) and track the responding partner in real time
  • To schedule, confirm, and manage service & maintenance bookings at network workshops, and to share job-card status and estimates
  • To issue, activate, renew, and process claims under extended warranty plans, including verifying eligibility and coverage
  • To process spare parts enquiries, quotations, orders, invoicing, and delivery tracking
  • To process payments and issue invoices/receipts
  • To communicate service updates, OTPs, reminders, and offers via SMS, email, call, or WhatsApp
  • To resolve complaints, process refunds, and provide customer support
  • To improve our Services, conduct internal analytics, and prevent fraud or misuse
  • To comply with applicable law, regulatory requests, and to enforce our Terms of Use

5. Vertical-Specific Data Processing

5.1 Roadside Assistance (RSA)

When you raise a breakdown request, we collect your live location, vehicle details, and issue description to dispatch the nearest towing/service partner. Your mobile number and location may be shared with the assigned RSA partner solely to enable pickup and response coordination. Call recordings with our RSA helpline may be retained for quality and dispute-resolution purposes.

5.2 Service & Maintenance

When you book a service at a FixorAssist network workshop, we share your booking details, vehicle history (where available), and contact information with the assigned workshop to enable job-card creation, estimate approval, and service completion. Photos/videos of your vehicle taken during inspection or repair may be stored to document work performed and for warranty/claim reference.

5.3 Extended Warranty Sale

For extended warranty products, we collect vehicle age, odometer reading, prior service history, and PDI (Pre-Delivery Inspection) records to assess eligibility and pricing. Policy and claims data (including repair invoices and part failure details) are processed to administer coverage and settle claims, and may be shared with our underwriting/insurance partners strictly for that purpose.

5.4 Car & Bike Spare Parts Supply

For spare parts orders, we collect vehicle make/model/VIN to identify compatible parts, along with delivery address and payment details to fulfil the order. Where orders are routed through our marketplace network, vendor-facing systems receive only the information necessary to quote, invoice, and dispatch the part (see “Identity Vault” principles in Section 6).

6. How We Share Your Information

We do not sell your personal data. We may share information with:

  • Empanelled RSA, workshop, bodyshop, and spare parts vendor partners — limited to what is needed to fulfil your specific request
  • Insurance companies and OEM/dealer partners for warranty issuance, cashless claim processing, and PDI programs
  • Payment gateways and logistics providers to process transactions and deliveries
  • Our franchise partners operating under the FixorAssist brand in their designated territory
  • Group companies, auditors, and professional advisors under confidentiality obligations
  • Law enforcement, courts, or regulators where required by law or to protect our legal rights

Where vendor-facing marketplace systems are used for spare parts sourcing, we follow a blind-marketplace approach that limits direct exposure of customer identity to unrelated third-party vendors beyond what is operationally necessary.

7. Data Storage & Security

We store personal data on secure servers located in India (or with cloud infrastructure providers offering equivalent safeguards) and implement reasonable security practices, including encryption in transit, access controls, and role-based permissions, to protect data against unauthorised access, alteration, disclosure, or destruction. Payment card data is handled exclusively by our PCI-DSS compliant payment gateway partners.

While we take reasonable steps to protect your data, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Data Retention

We retain personal data for as long as necessary to provide the Services, fulfil the purposes described in this Policy, and comply with legal, accounting, or reporting obligations. Warranty and claims records are typically retained for the duration of the coverage period plus the applicable statutory limitation period. Call recordings and chat logs are generally retained for a limited period for quality assurance and grievance-redressal purposes, after which they are securely deleted or anonymised.

9. Cookies & Tracking Technologies

Our website and app use cookies, SDKs, and similar technologies to remember your preferences, keep you logged in, understand usage patterns, and improve performance. You can control cookies through your browser settings; disabling cookies may limit certain features of our Services.

10. Your Rights

Subject to applicable law, you have the right to:

  • Access the personal data we hold about you
  • Request correction of inaccurate or incomplete data
  • Request deletion or withdrawal of consent, subject to any legal/contractual obligation to retain such data (e.g., active warranty or claim records)
  • Opt out of promotional communications (SMS/email/WhatsApp) at any time
  • Lodge a grievance with our Grievance Officer (Section 12) regarding processing of your data

Withdrawing consent or requesting deletion of certain data may affect our ability to provide RSA, warranty, service, or spare-parts fulfilment to you.

11. Children's Privacy

Our Services are intended for individuals who are at least 18 years of age or the age of majority in their jurisdiction. We do not knowingly collect personal data from minors. If we become aware that we have inadvertently collected data from a minor, we will take steps to delete it.

We may update this Policy from time to time to reflect changes in our practices, technology, legal requirements, or the addition of new FixorAssist verticals. The “Last Updated” date at the top of this Policy indicates when it was last revised. Material changes will be notified through our website or app. Your continued use of the Services after such changes constitutes acceptance of the updated Policy.

14. Governing Law & Jurisdiction

This Policy is governed by the laws of India. Any disputes arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts at Delhi, India.
